Please read these terms of service, including any annexes and/or amendments (“Terms of Service” or “ToS”), carefully as it constitutes a legally binding agreement between you and Fancade AB and its Affiliates. “Affiliates” are entities that (in)directly control, are controlled by or are under common control with Fancade (Fancade AB and its Affiliates are referred to as “Fancade”).
These Terms of Service govern your use of the Fancade websites, games and related services. By using the Fancade websites, games and/or related services, you agree to be bound by the terms and conditions of these Terms of Service. The most recent version can be found at https://www.fancade.com/terms/.
Fancade believes it is important to be transparent about how we process your personal data. For more information we refer to our privacy notice which can be found at https://www.fancade.com/privacy/.
Please find directly below some information about our processing of your data in general. Beneath, you will find an overview of various topics.
The Game(s), Websites and App together are the “Services”.
The “Game(s)” are the games that are made available at any given time by Fancade through the Websites and/or the App.
The “Websites” are the websites used by Fancade, including without limitation www.fancade.com and play.fancade.com.
The “App” is the Fancade mobile app, found at, including without limitation, the Google Play Store and the App Store.
A “User” is the person to whom Fancade grants a right to use the Services under and in accordance with these ToS. Any reference to “you” in these ToS will mean a User.
By downloading and/or using the Services, you acknowledge that you are at least 18 years old. In case you are under 18 years old, please note that you may only use the Services when your parent or legal guardian agrees to these ToS. Fancade may immediately suspend your access to the Services in case we suspect that you are younger than 18 years or old and your parent or guardian has not agreed to these ToS.
All games, works and/or materials (including text and images) that a User submits or has created for, with and/or based on the Services are called “User Content”. The Services are meant for Users to play Games, but also to create their own User Content based on the Games or other, existing User Content. This means that all Users can make derivative games of the existing Games on the Websites and App. By posting your own User Content on Fancade, you expressly agree to other users creating derivative works from your User Content and you hereby provide Fancade and such users with an appropriate license thereto, subject to these Terms of Service.
All games, works and/or materials (including text and images) that a User submits or has created for, with and/or based on the Services are called “User Content”. The Services are meant for Users to play Games, but also to create their own User Content based on the Games or other, existing User Content. This means that all Users can make derivative games of the existing Games on the Websites and App. By posting your own User Content on Fancade, you expressly agree to other users creating derivative works from your User Content and you hereby provide Fancade and such users with an appropriate license thereto, subject to these Terms of Service.
You take full responsibility and liability for any User Content uploaded by you. Fancade is not liable in any way for any User Content and expressly excludes any liability for User Content. User Content you provide must:
be your own original creation;
not be materially similar to other third party game(s);
not constitute gambling, betting or would otherwise try to gain monetary gain, for example by having an aim to get players to donate money, virtual currencies or virtual items;
not contain any malware, trojan horses or other viruses;
not infringe upon any third-party Intellectual Property (“IP”) Rights; and/or
not be offensive, indecent, defamatory, libelous, unlawful, or otherwise harmful.
By submitting User Content you give Fancade (expressly including its Affiliates) a free, perpetual, irrevocable, worldwide, sublicensable, and non-exclusive license to use, store, copy, modify, commercialize, distribute, make available to the public and/or publish that content. This license has the following license limitations:
You retain ownership of your original content.
You may request removal of your content, subject to technical limitations.
You explicitly agree and understand that the abovementioned licence is free of charge and that Fancade owes you no compensation whatsoever.
You may only submit content for which you have the necessary rights to grant Fancade the license mentioned above.
You understand and agree that all Users may use your User Content to create their own User Content. By submitting User Content you give all Users a free, worldwide, sublicensable and non-exclusive license to create and publish derivative works of your User Content.
If you are making User Content, it is recommended to make frequent backups by copying the game box as progress may be lost due to bugs and/or errors in the Services.
To use the Services and/or upload User Content you may need to register for an account (“Account”). To register for an Account, you will need to follow the instructions on the Website and submit certain information, such as a username.
You warrant and undertake that all the information you supply during registration for your Account is truthful, complete and correct. You accept and understand that you are obligated to ensure that all information held about you by Fancade is up to date. You can notify an update to your registration details at any time by editing the information contained within your Account.
Any username and password chosen by or issued to you upon or for registration with Fancade is personal to you and should only be used to facilitate your personal use of and access to the Services. Do not share your personal and/or Account information with any other person or allow any other person to use your Account. You accept and understand that you are solely responsible for all use of the Services undertaken through your Account.
If you believe that the security of your username, password and/or Account may have been compromised, you must immediately change your login credentials and inform Fancade at support@fancade.com.
Fancade is not liable for losses or damage resulting from any negligent or improper use of your Account or any use that results from failure to comply with the ToS.
Fancade brings together Users from all over the world. Be nice to each other, and to us. In particular, you are expected to refrain from “Prohibited Activities”.
Prohibited Activities include:
Using any automated system or unauthorized scripts to access the Services, except for standard browser usage.
Disrupting or creating undue burden on the Services or its networks.
Bypassing measures that restrict access to any part of the Services, including without limitation the in-game purchases.
Circumventing, hacking, interrupting or interfering with any Services’ features.
Deciphering, decompiling, disassembling, or reverse engineering any software and/or data of the Services.
Copying or adapting the Services, including HTML or other code.
Reselling, redistributing, copying, reproducing, or exploiting the Services.
Creating and/or distributing derivative works of the Services.
Using the Services and/or engaging in activities in violation of any Applicable Law, and/or using the Services for any illegal and/or immoral behaviour.
If you discover a bug, corrupted data, or exploit that circumvents the intended functionality of the Services, don't use or publicize it. Instead, report it to support@fancade.com so we can fix it. Please also reach out to us if you suspect breach of these terms by another User, for example a User engaging in illegal activities.
Fancade uses a virtual currency called “Gems”, which can be bought via in-app purchases and can be used to unlock additional functionalities. It is important to note that Gems are not a real currency and have no monetary value. Gems represent a limited, non-transferable, non-exclusive license to use some features of Fancade for personal use.
Gems are not returnable, exchangeable, or refundable, either for real-world currency or for real-world goods and/or services.
It is not guaranteed that you will earn Gems from your User Content.
Gems cannot be gifted, exchanged, or sold between Users.
Refunds for technical issues will be processed according to applicable consumer protection laws.
For purchases made by EU and/or UK consumers:
You have fourteen (14) days to withdraw from gem purchases without giving reason (“Withdrawal Period”).
The Withdrawal Period begins from the date of purchase.
If you begin using purchased Gems, you expressly consent to immediate performance and acknowledge loss of withdrawal rights and the end of the Withdrawal Period for consumed Gems.
To exercise withdrawal rights, contact support of the relevant app store where you have purchased your Gems.
When purchasing Gems, additional third-party terms and conditions may apply. Please thoroughly read these documents prior to purchasing any Gems. Fancade is not liable for any issues or damages regarding the purchase of Gems through third-party platforms.
For purchases in the Google Play Store, please refer to the relevant Google terms and conditions.
For purchases in the Apple App Store, please refer to the relevant Apple terms and conditions.
Regarding Accounts:
If Fancade is notified or otherwise has reason to believe that the information you have provided is fully or partly inaccurate, incomplete or not up-to-date, Fancade has the right to request that you provide updated information without delay. If you fail to provide, correct, update or complete the information as requested, Fancade is entitled to block you from using the Services until you have fully complied with the request.
If your Account has been terminated or suspended by Fancade, you may no longer use the Services.
Regarding User Content:
Fancade has the right to monitor whether your User Content is in compliance with these ToS and/or Applicable Law.
Fancade reserves the right to modify and/or adjust any User Content, at any time, up to its sole discretion.
Fancade reserves the right to remove any User Content from the Websites, at any time, up to its sole discretion.
Regarding Gems:
Fancade may change the purchase price at its sole discretion with thirty (30) days advance notice to the Users
Fancade may change rules for earning free Gems at any time at its sole discretion.
Fancade may remove or restructure Gems or the Fancade economy at any time at its sole discretion, without any liability.
Should an obviously incorrect price for Gems be shown for any reason, Fancade reserves the right to offer the Gems for the correct price. You do not have rights to buy Gems for an incorrect price.
Fancade reserves the right, in its sole discretion, to remove any Game(s) or other content, at any time and without prior notice, if Fancade considers the content or use in breach of these ToS, subject to applicable consumer protection laws. Fancade also reserves the right to remove content at its sole discretion, for any reason (subject to Applicable Law).
Without prejudice to other remedies, Fancade may immediately restrict, suspend, or terminate your Account and/or your use of the Services if Fancade has reasonable cause to believe that:
You are creating problems or possible legal liabilities for Fancade or third parties.
You are infringing the rights of Fancade or third parties.
You have performed or tried to perform one or more Prohibited Activities.
You are violating the ToS in any other way.
You may appeal moderation decisions through support@fancade.com. Appeals are generally reviewed by different personnel within fourteen (14) days. Filing an appeal does not mean that the moderation decision will be changed. Fancade will provide clear reasoning for User Content removal or Account restrictions.
You may at all times report any infringing User Content. You can do so by contacting support@fancade.com.
We review reported content within three (3) working days. Decisions are based on these terms and community guidelines. Fancade provides clear reasoning for content removal or account actions.
You may appeal to User Content moderation decisions through support@fancade.com. Appeals are reviewed by different personnel within fourteen (14) days. Filing an appeal does not mean that the User Content decision will be changed.
“IP Rights” are all copyrights, database rights, trademarks and other intellectual property rights anywhere in the world, whether registrable or unregistrable, registered or unregistered, including any application or right of application for such rights.
All IP Rights related to the Services are owned by Fancade. The Game(s) are being licensed to you and you hereby acknowledge that no title or ownership in the Game(s) is being transferred or assigned, neither explicitly nor implicitly. All rights that are granted to you are expressly mentioned in and are limited by the ToS. All rights not expressly granted are reserved by Fancade.
Subject to these ToS, Fancade hereby grants you a non-exclusive, non-transferable, non-sublicensable, limited license to use the Game(s) for your non-commercial, personal use. The license is granted on the date that you first use the Services and the license ends when either you stop using the Services or if Fancade terminates the license granted to you, whichever of those is earlier.
Subject to these ToS, Fancade hereby grants you a limited, revocable, royalty-free license to stream your gameplay of the Game(s) or User Content, through third-party streaming platforms. You may not stream any Game or User Content on platforms that display offensive, indecent, defamatory, libelous, unlawful, or otherwise harmful content. This license to stream the Game(s) is subject to the additional conditions:
You may only stream your own content (e.g. your own gameplay/User Content or your reaction to Games or User Content).
The streamed gameplay may not contain any leaked, hacked, or unauthorized content, or any content related thereto.
When streaming, you assume all liability for the streamed gameplay and any monetization thereof.
Fancade may revoke this license for any reason and at any moment.
The licenses that are granted to you are subject to your compliance with all terms and conditions of the ToS and/or any other terms provided for by Fancade. Fancade has the right to suspend or terminate your license in case you do not comply with these ToS or other Fancade terms. The abovementioned licenses end immediately if:
you (attempt to) violate these ToS or any other terms provided for by Fancade;
these ToS are terminated; or
Fancade, at its sole discretion, terminates your license.
Fancade makes use of WebP technology, which is subject to the following license: “Copyright (c) 2010, Google Inc. All rights reserved”.
Redistribution and use in source and binary forms, with or without modification, are permitted provided that the following conditions are met:

Fancade may modify the ToS at any time, at its sole discretion. If Fancade does so, it will let you know by updating the ToS page and sharing it on the Websites.
If you disagree with changes and/or decisions you may terminate your Account and/or use of the Services before changes take effect. Continued use of the Services after the changes have been announced constitutes acceptance of the changes. Changes do not affect your existing consumer rights.
Fancade reserves the right to change, modify, update, revise, suspend, remove, or discontinue the Services, User Content and/or any related features, wholly or in part, at any time and without notice, at Fancade’s sole discretion. You have no right to object against these changes.
The Services are provided "as is" and "as available". Except as expressly provided and to the fullest extent permitted by Applicable Law, Fancade disclaims all warranties, representations, or endorsements, whether express or implied, regarding the Fancade Services. This disclaimer includes, without limitation, warranties of merchantability, fitness for a particular purpose, non-infringement, title, quiet enjoyment, custom, trade usage, system integration, accuracy, completeness, usefulness, uninterrupted access, error-free operation, and freedom from defects.
Fancade makes no representation or warranty regarding the legality of your use of the Services in any jurisdiction. Your use of these Services is solely at your own risk. Fancade specifically disclaims liability for any direct, indirect, consequential, punitive, or other damages or losses arising from or related to the use of the Services.
Fancade has no obligations related to uptime, downtime, maintenance, service continuity, updates, corrections, or releases. Fancade does not guarantee continuous availability or functionality, and may experience interruptions, delays, errors, or downtime due to maintenance, hardware or software issues, or third-party service disruptions. Fancade is not liable for any loss, damage, injury, claim, or inconvenience arising from such interruptions or the discontinuation of Services.
You acknowledge and agree that:
the Services may not work as intended and/or may cease to be available;
the Services may be shut down wholly or in part;
Fancade is not responsible for your software or browser compatibility, hardware, or network connections with the Services, nor for your access, availability, use, timing, receipt, or accuracy of the Services;
Gems or other in-game items you have acquired may cease to be available;
in-app purchases may fail or be incorrectly calculated, in which case you should contact support for help fixing the issue, or having the purchase refunded; and
no method of transmission over the internet, or method of electronic storage is fully secure and reliable, and Fancade cannot guarantee the absolute security of information you send us.
“Applicable Law” means any legislation governing the ToS, as is applicable in Sweden, including but not limited to laws, regulations, EU directives, court orders and decisions of authorized entities.
The ToS and any other terms provided for by Fancade are governed by and interpreted as per the Applicable Law. EU consumers retain protection under their country of residence's consumer protection laws.
To the extent permitted under Applicable Law, Fancade and you both agree to submit to the exclusive jurisdiction of the courts of Linköping, Sweden.
By using the Services, you guarantee that:
you agree to comply with the ToS and Applicable Law;
you will not use the Services through automated or non-human means, whether through a bot, script or otherwise; and
you will not use the Services for any illegal or unauthorized purpose.
You agree to indemnify and hold harmless Fancade and its Affiliates from any losses, damages, or claims made by third parties. This includes covering reasonable attorney fees and costs. The claims may arise from:
a breach of the above representations;
your participation in Prohibited Activities;
your User Content;
your violation of others' rights, like intellectual property; and/or
your use of the Services in a harmful manner.
Fancade may take over the defense of any situation requiring your protection, and you must assist at your own cost. Fancade will inform you about any related claims, actions, or proceedings as soon as possible. Fancade reserves the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.
Fancade will only be liable for the damage that you suffer as a result of an attributable failure in compliance with any provision under the ToS, if compliance by Fancade is not forthcoming after you have given Fancade notice of default in writing and has provided a period of 30 (thirty) days to fulfil the obligation concerned.
Any liability for indirect loss and/or consequential loss is excluded, such as:
loss profit;
loss savings;
loss of or reduced goodwill; and/or
loss due to business interruption.
Any limitation of liability on the basis of the ToS will not apply if the damage is resulting from personal injury, death, willful misconduct or gross negligence caused by intent and/or willful recklessness.
For the avoidance of doubt, under no circumstances shall Fancade be responsible and/or liable for the fulfilment of any contractual obligations of third parties.
Fancade is committed to making the Services accessible to users with disabilities. We strive to comply with applicable law on accessibility.

The ToS constitutes the entire agreement and understanding between you and Fancade, and operates to the fullest extent permissible by Applicable Law.
The failure to exercise or enforce any right or provision of the ToS shall not operate as a waiver of such right or provision.
Fancade may assign any or all rights and obligations under the ToS to others at any time. You may not assign any rights or obligations under this ToS to others.
If any part of the ToS is found unlawful or unenforceable, it will be removed without affecting the remainder of the ToS. Fancade may then replace the original unlawful or unenforceable part with a new part that is as close as possible to the original.
You agree not to interpret the ToS against Fancade for drafting them and waive any defenses related to their electronic form or lack of signatures.
These ToS shall remain in full force and effect while you use the Services.
You may terminate ToS at any time by stopping the use of the Services.
Fancade may terminate this ToS at any time, without notice or reason, at its sole discretion.
We will provide at least 30 days' advance notice of material changes by:
email notification to Users;
prominent notice in the App; and/or
publication on our Websites.
